Dilemma: You are the President of the United States. You are advised that a commercial airliner has been hijacked by a terrorist who claims to have a bomb on board. The terrorist has diverted the flight and the plane is headed toward Yankee Stadium where the third game of the World Series is underway. Although the United States Constitution provides that everyone in the United States must be treated with respect and fairly in the criminal justice system, the criminal justice system has not been effective in providing equal protection and treatment of the American people. The 14th Amendment to the U.S. Constitution, ratified in 1868, granted citizenship to all persons born or naturalized in the United States—including former enslaved people—and guaranteed all citizens "equal protection of the laws.
